More Than 3,700 Patients Exposed to HIV and Hepatitis in New Jersey: Baltimore Medical Malpractice and Mass Tort Attorneys Schochor, Staton, Goldberg, and Cardea, P.A., PA Admitted to Case

After filing a Motion for Admission Pro Hac Vice, Jonathan Schochor, from the Baltimore law firm of Schochor, Staton, Goldberg, and Cardea, P.A., have been admitted to the United States District Court for the District of New Jersey in the medical malpractice/mass tort case in Saddle Brook, New Jersey involving HealthPlus Surgery Center. According to the State Department of Health, HealthPlus Surgery Center, an ambulatory surgery center in New Jersey, may have exposed over 3,700 patients to HIV and Hepatitis due to substandard infection control and sterilization procedures. Schochor, Staton, Goldberg, and Cardea, P.A., currently represent over 200 victims with the number continuing to grow on a daily basis.

What we know about the case

On September 7th an investigation by the New Jersey Department of Health concluded that HealthPlus Surgery Center was not following standard sterilization and medication dispensing procedures. The Department of Health closed the center between September 7th and 28th.  It was later determined that patients treated at the Saddle Brook surgery center between January 1st and September 7th, 2018 may have been exposed to HIV and Hepatitis.

Here are some other facts about the case:

  • Testing. All patients who attended the center between Jan 1st and September 7th should be tested for HIV, Hepatitis B and Hepatitis C by a third-party.
  • Improvements. During the time the center was closed, infection control was improved, new staff was hired, and the staff was trained.
  • Confirmed cases. According to HealthPlus and the New Jersey Department of Health, at the time of writing, there are five confirmed cases of infection that resulted from the center’s negligence. Due to the unpredictable incubation period and the varying conversion time, as well as false negative and other testing errors, patients will need to be tested and retested for months and years.
